Resumo O presente estudo trata da impossibilidade de inclusão de créditos constituídos após a data do ajuizamento da recuperação judicial, com interpretação do artigo 49, caput, da Lei 11.101 de 2005. São analisados, em cada capítulo, conceitos como créditos a serem habilitados e impugnados, princípios norteadores da recuperação judicial e características da Assembleia Geral de Credores, com intuito de avaliar os efeitos que a flexibilização da norma supracitada pode acarretar no sistema recuperacional vigente. Os efeitos analisados são, basicamente, a insegurança jurídica e negocial, o desestímulo à atividade econômica, a não celeridade do rito recuperacional, o enfraquecimento do direito do credor na Assembleia Geral e a facilitação de fraude contra credores. A jurisprudência e precedentes, com enfoque em julgados recentes do Tribunal de Justiça do Estado do Rio Grande do Sul e da Vara de Direito Empresarial, Recuperação de Empresas e Falências de Porto Alegre, são, concomitantemente, impulso para a discussão e exemplo para considerações maiores.
Abstract

The present study analyzes the impossibility of including credits constituted after the date of filing the Judicial Recovery, with interpretation of art. 49, main clause, of Law 11.101 of 2005. In each chapter, concepts such as credits to be admitted and challenged, principles guiding the judicial recovery and characteristics of the General Meeting of Creditors are analyzed with the purpose of evaluate the effects in the current recovery system that might be caused by that the flexibilization of the norm. These analyzed effects are the legal and negotiating insecurity, discouragement of economic activity, non-celerity of the judicial recovery, weakening of the creditor's rights at the general meeting and, facilitating fraud against creditors. The precedents, with a focus on recent judgments of the Rio Grande do Sul State Court of Justice and the Bar of Corporate Law, Judicial Recovery and Bankruptcy of Porto Alegre, will be, at the same time, a stimulus to discussion and an example for larger considerations .
