O DIREITO DIGITAL E AS IMPLICAÇÕES CÍVEIS DECORRENTES DAS RELAÇÕES VIRTUAIS

RESUMO: O trabalho versa acerca da importância do vínculo do Direito com a Internet na sociedade moderna, que é notório, e sobre a necessidade de adaptação a essa nova realidade. A proteção legal, no Brasil, é de difícil definição, vez que o tratamento jurídico deste instituto não é encontrado na literatura técnica brasileira. Este trabalho propõe uma análise conceitual e sistemática da matéria, sob o viés do autor, a fim de determinar as implicações cíveis na delitualidade dos crimes cibernéticos. Ante a escassa presença de material didático sobre o assunto, foi buscada junto à experiência internacional base técnica e teórica para as constatações tecidas nesse trabalho.

ABSTRACT: The importance of the relationship between law and Internet in modern society is notorious, and adapting to this new reality is imminent. Legal protection in Brazil is hard to define, since the legal treatment of this institute is not found in Brazilian technical literature. This work proposes a conceptual and systematic analysis, under the viewpoint of the author, to determine the civil implications of cyber crimes. Due the lack of technical literature, it has been researched in the international literature for technical and theory based to improve this work.
