Religião e sociedade: as relações entre o estado e as concepções religiosas na formação do ordenamento social e jurídico

Resumo: O presente artigo tem por objetivo mostrar a estreita ligação e profunda influência da Religião sobre o Direito e igualmente nas relações sociais, e seu vínculo com as atividades estatais. A relação simbiótica que se estabeleceu entre Direito e Religião nos primórdios da humanidade é sentida atualmente na medida em que o ordenamento jurídico institui arbitrariamente normas que privilegiam determinada religião em detrimento das demais. Analisando sob uma perspectiva crítica a forte presença da religião nas relações sociais e nos textos constitucionais, a Concordata Brasil-Santa Sé e o protestantismo como impulsionador do capitalismo estatal, busca-se entender de que maneira o Estado, embebido por concepções religiosas, impõe deveres incoerentes com seus princípios e objetivos aos cidadãos. Com essas análises, chega-se à ideia da construção de um o Estado laico como forma de garantir e respeitar as mais diversas matrizes religiosas que compõem os traços culturais de uma nação.

Abstract: The present paper aims to show the close connection and deep influence of Religion about Law and equally social relations, and its bond with State activities. The symbiotic relation developed between the Law and Religion in the beginnings of mankind is felt today as in legal planning that establishes arbitrary standards that favor particular religion over other. Analyzing from a critical perspective the strong presence of religion in social relations and constitutional texts, the Brazil-Holy See Concordat and Protestantism as a booster of State capitalism, we seek to understand how the State, impregnated with religious conceptions, imposes duties incoherent with its principles and objectives to the citizens. With these analysis, we arrive at the idea of the building of a secular state as a form of guarantee and respect the diverse religious matrices that make up the cultural traits of a nation.
